No Limits Health Clubs Membership Agreement & Terms and Conditions

Welcome to No Limits Health Clubs. By becoming a member, purchasing a visit pack, or using our facilities as a casual visitor, you agree to follow the terms and conditions outlined below. These terms explain your rights and responsibilities and set out what you can expect from us as your gym. Please read them carefully before joining, purchasing a visit pack, or entering as a casual visitor.

1. Definitions

Agreement – This Membership Agreement between you and No Limits Health Clubs.
No Limits Health Clubs – The No Limits 24/7 gym facility where your membership was initiated.
No Limits – The owner and operator of the Club, including its affiliates, employees, representatives, officers, and subsidiaries.
Club – All No Limits Health Clubs locations across Australia.
Member / You – The individual applying for membership, including any parent or guardian co-signing for a member under 18 years old.

2. Membership Rights & Obligations

2.1 Membership Access
Your membership grants access to the premises, facilities, equipment, and services included in your membership type at No Limits Health Clubs Maryborough. Memberships are non-transferable and may not be assigned or sold to another person. Management approval is required for any special exceptions.

2.2 Tailgating & Access Rules

•Individual Access Only: Your access pass or fob is for your use only and must be scanned on every entry into the Club.

Tailgating Detection: The Club operates a tailgating detection system to monitor when more than one person enters following a single scan. Allowing another person to enter without scanning their own access pass will be treated as unauthorised entry.

Non-Compliance Fee: Any breach of access rules, including tailgating, will result in a $150 non-compliance fee and may also lead to suspension or cancellation of membership.

Why Scanning Matters: Regularly scanning your access pass allows us to:

•Keep track of member visit activity so we can recognise and reward our most active members, and

•Maintain an accurate record of who is in the Club at any time, which is critical for safety in the event of an evacuation.

2.3 Member Responsibilities
Members are expected to:

•Use a towel on all equipment and benches.

•Wear appropriate footwear and clothing.

•Wear clean shoes at all times and avoid tracking dirt, mud, or debris into the Club.

•Avoid creating excessive mess. Where additional staff cleaning is required due to member actions (e.g. mud, spills, rubbish left behind), a $50 cleaning fee may apply.

•Re-rack all weights, return equipment to its proper location, and keep workout areas tidy. Failure to re-rack weights may result in a $50 re-racking fee.

•Respect staff, other members, and Club property.

•Follow all posted signs, safety guidelines, and directions from staff.

•Immediately report any equipment faults, accidents, or incidents.

•Understand that repeated failure to comply with these responsibilities may result in suspension or termination of membership.

2.4 Membership Suspension
• Suspension is available under No Limits' suspension policy.
• All fees must be paid and your account must be current before suspension is approved.

2.5 Age Restrictions
• Minimum age: 14 years.
• Members aged 14–16: Allowed access at any time. A fitness assessment with a certified instructor (Cert III or higher) is recommended.
• Members under 18: Require a parent/guardian co-signature.

2.6 Student Discount Eligibility

The student discount is only available to secondary school students who:

• Hold a current and valid student ID, and

• Are 19 years of age or under at the time of joining.

Student status will be verified during the sign-up process by providing a valid student ID, school ID, or other acceptable proof of enrolment. Where required, a parent/guardian may be asked to confirm eligibility.

The discount is offered as a promotional benefit only and may not be available on a continuous basis. Proof of student status must be provided before the discount can be applied. The discount is non-transferable, cannot be combined with other offers, and is valid only for the specified promotional memberships.

2.7 Identification & Profile Photo Requirements

• All new members are required to provide a profile photo during the sign-up process. This is a condition of membership and is used for access control, security, and to prevent unauthorised entry. Membership cannot be completed without a profile photo.

• Members aged 18 and over will also be asked to provide a valid government-issued photo ID (e.g., driver’s licence, passport, or proof of age card) at sign-up for identity verification.

• Members aged under 18 may instead provide a current student card or have a parent/guardian present at sign-up to provide their own government-issued photo ID and co-sign the agreement.

• If a member does not provide photo ID at sign-up, No Limits Health Clubs reserves the right to request it at a later date before granting full or continued access.

• All profile photos and identification documents are stored securely in the Club’s membership system and used strictly for verification and safety purposes. They will not be shared or used for promotional purposes without the member’s written consent.

Plain English Explanation
🔑 Photo ID & Profile Photo at Sign-Up
When you join No Limits, we’ll ask for two things:

Profile Photo (required) – Everyone needs to upload a quick photo during sign-up. This helps us keep the gym secure, makes sure your fob/app access is only used by you, and lets our team recognise you if needed.

Photo ID (requested) – If you’re 18 or over, we’ll also ask for a government-issued photo ID (like a driver’s licence or passport). If you’re under 18 and don’t have one, a student card or having a parent/guardian verify your sign-up is fine.

If you don’t upload an ID right away, don’t worry — you can still finish joining. We may ask for it later before granting full or ongoing access.

👉 Your photos and ID are stored securely in our system and used only for membership verification and safety. We never use them for marketing without your permission.

3. Fees & Payments

3.1 Joining & Access Fees
• $69 one-time joining and access activation fee (covers initial setup and access to the Club, regardless of access method used).
• $2.20 EZYPAY load fee/direct debit establishment fee (if using direct debit for ongoing payments).
• Pro-Rated Upfront Fee: A one-off partial membership payment calculated from the daily rate ($19.95 ÷ 7 = $2.85 per day) multiplied by the number of days from your join date until your first regular weekly debit date. This is your first week's partial payment.

 

 

 

 

 

 

 

 

3.2 Dishonour Fees
• $9.95 fee applies to any failed or missed direct debit payment.

3.2 (a) Failed Payment Recovery
• If a direct debit payment fails, the amount will be automatically re-attempted on your next scheduled billing cycle.
• At that time, you will be charged your regular membership fee plus any outstanding balance from the failed payment plus the dishonour fee of $9.95.
• This process will continue for up to four (4) consecutive billing cycles.
• If payment remains outstanding after four (4) failed billing cycles, your access to the gym will be suspended until the balance is cleared in full.

3.3 Membership Fee Changes
• No Limits may adjust fees with 14 days' written notice sent to your last known email or postal address.

3.4 Referral Offer – Terms & Conditions

• The referral code must be provided at the time of sign-up for a weekly direct debit membership.

• The referred friend will receive a $10 discount on their joining fee.

• The referring member will receive a $10 credit toward their membership fees for each successful referral.

• Credits are applied three (3) days after the referred friend’s sign-up, provided their membership remains active.

• Unlimited referrals are permitted.

• From time to time, No Limits Health Clubs may run special offers where the referral reward and/or new member discount is increased.

• No Limits Health Clubs reserves the right to change, suspend, or end this promotion at any time, including adjusting the discount or credit amounts offered.

 

3.5 Visit Packs & Casuals

• The 5 Visit Pack provides 5 single-entry passes to No Limits Health Clubs.

• Passes are valid for 30 days from the date of purchase. Any unused visits after this period will expire and are non-refundable.

• Visit Packs are for individual use only and cannot be shared, transferred, or suspended.

• Access is provided via Bluetooth entry through the GymMaster app. No access card or fob is required.

• Visit Packs do not include membership benefits.

• A joining fee does not apply to Visit Packs.

•Casual visits are available at the current advertised rate and must be paid prior to entry.

3.6 One-Month Prepaid Membership

• Provides full access to No Limits Health Clubs for 30 consecutive days from the date of purchase.
• Membership automatically expires after 30 days and does not roll over.
• Non-refundable and non-transferable.
• Not eligible for any joining fee discounts, referral credits, or promotional offers.
• Access is provided via Bluetooth entry through the GymMaster app (no card or fob required).

3.7 Promotional Discounts
No Limits Health Clubs reserves the right to withdraw, amend, or limit promotional discounts (including student discounts) at any time, at its sole discretion.

3.8 Prepaid Memberships – Refund & Transfer Policy
• Prepaid memberships of any duration (1 month, 3 months, 6 months, or 12 months) are strictly non-refundable and non-transferable once purchased.
• No refunds or credits will be issued for early termination, change of mind, relocation, or non-use of the membership.
• Prepaid memberships may be paused in line with No Limits’ suspension policy.
• Exceptions to the non-refund rule apply only in cases of permanent illness, incapacity, or death, with appropriate supporting documentation provided to management.

 

4. Cancellation, Suspension & Termination

4.1 Cooling-Off Period

•You may cancel within 48 hours of signing.

•The joining fee and any pro-rata payments are non-refundable.

•If you cancel in this period, you will not be held to the standard 30-day notice period required for cancellation.

•Your membership will be cancelled immediately, and no further payments will be taken.

 

4.2 Member-Initiated Cancellation

•After the 48-hour cooling-off period has passed, members may cancel by completing the digital cancellation form located on the Club iPad. Cancellations are not accepted by phone, email, or other methods.

•A 30-day notice period applies to all cancellations.

•All fees must be paid and your account must be up to date before cancellation can be processed.

•Prepaid memberships are non-refundable except in cases of permanent illness, incapacity, or death (documentation required).

4.3 Club-Initiated Termination
• No Limits may terminate your membership for non-payment, breach of policies, or misconduct.
• Prepaid fees will not be refunded for terminations due to member breach.

5. Health & Safety

5.1 Medical Conditions
• You confirm you are medically fit to use gym facilities.
• You must notify No Limits of any health concerns.
• No Limits does not provide medical advice.

5.2 Equipment Use
• Follow all posted instructions and staff guidance.
• A towel must be used on all equipment.
• Return equipment to its original location after use.

5.3 Liability Release
• You use the gym at your own risk.
• No Limits is not liable for injuries, loss, or property damage.
• You agree to indemnify No Limits for claims resulting from your actions.

5.4 Outside Equipment
• For safety and insurance reasons, members are not permitted to bring or use personal or outside fitness equipment (including but not limited to straps, harnesses, bands, or attachments) unless expressly approved in writing by No Limits management.
• Any member who uses non-approved equipment does so entirely at their own risk.
• No Limits accepts no responsibility or liability for injuries, loss, or damage arising from the use of outside equipment. Members agree to indemnify No Limits, its staff, and management from any claims resulting from such use.

6. Gym Policies

6.1 Dress Code
• Appropriate gym attire and enclosed sports shoes are required.
• Offensive prints or designs are prohibited.

6.2 Towel Usage
• Towels are required during all workouts for hygiene.
• Failure to comply may result in suspension of access.

6.3 Children's Access
• Minors may use the gym at their own risk.
• Supervision by a responsible adult is recommended.
• No Limits accepts no liability for unsupervised minors.

7. 24/7 Access & Unstaffed Hours

7.1 Access Methods
• Members are provided with a secure access method (such as a card, fob, or mobile-based entry).
• Lost or damaged access devices can be replaced for $25.
• Bringing a non-member into the gym during unstaffed hours incurs a $150 non-compliance fee.
• Members may bring a friend into the gym during unstaffed hours, provided the friend immediately pays the $12 casual visit fee via the QR code located at the front desk before commencing their workout.
• If a friend enters and does not pay the casual fee via the front desk QR code, the member who granted access will be charged the $150 non-compliance fee.

7.2 Unstaffed Hours
• Entering during unstaffed hours is at your own risk.

7.3 Video Surveillance
• Premises are monitored 24/7 (excluding private areas).
• By signing, you consent to video recording.

8. Personal Property & Lockers

• No Limits is not responsible for lost/stolen items.
• Lockers are for day use only and are not security devices.
• Items left overnight will be stored for 2 weeks, then donated.

9. Personal Training & Image Use

9.1 Personal Training
• Only No Limits-approved trainers may conduct sessions.

9.2 Use of Images
• No Limits may use photos/videos of the premises for promotion.
• You may opt out by notifying management in writing.

10. Liability & Indemnity

10.1 Release of Liability
• You acknowledge the inherent risk of injury in gym activities.
• No Limits is not liable for injuries or accidents.

10.2 Indemnity
• You agree to indemnify No Limits from claims arising from your actions.

10.3 Property Damage
• Members causing damage are liable for repair/replacement costs.

11. Agreement Changes

This document is the entire agreement between you and No Limits. No verbal changes are valid unless in writing and signed by both parties. If any clause is found invalid, the remaining terms remain in force.
